If the notice period is not completed while leaving the job, the employee may be harmed
An employee's appointment letter usually has a notice period
The notice period is equal to the number of days the employee has to inform the company before leaving the job
Generally everyone knows that an employee who leaves the company without completing the notice period has to pay a small amount to the company for the remaining period of the notice period. Now know that in addition to this amount, such an employee will also have to pay 18% GST to the government. The Gujarat Authority of Advance Ruling said in a decision that an employee who leaves the company without completing the notice period will have to pay 18% of the Goods and Services Tax (GST) along with the salary amount to the company for the remaining period.
The company may specify a notice period on the employee's appointment letter. The notice period is one day before the employee has to resign. If the notice period of an employee is 2 months and the employee works for only one month after resignation then the company collects the remaining amount of salary from the employee. If the amount is Rs.1,00,000 then as per the decision of Gujarat Authority of Advance Ruling, the employee will have to pay a total of Rs.1,18,000 with 18% GST.
An employee of Amanil Pharmaceuticals had sought advance ruling in such a case.
The Gujarat Authority of Advance Ruling said this while ruling in a case involving Ahmedabad-based company Amanil Pharmaceuticals. An employee of the company demanded advance ruling in the case. The case had a 3 month notice period.
